How to submit a request to the customs authorities (SKAT)

The better information the rights holders are able to provide customs with, the better they are able to make the physical checks

The customs authority (SKAT) is authorised, on their own initiative to detain goods from countries outside the EU which are suspected of being counterfeited or pirated. The rights holder shall, however, lodge an application for action within three working days. Rights holders also have the possibility of submitting an application for action prior to the customs intervention. Such an application should include as much information as possible about the rights holder’s products, business and product characteristics, transportation routes, etc., to give customs the best basis for the preparation of risk analysis and detention. The rights holders can submit an application for action valid in one member state or an EU application for action valid in selected or all member states.  
The legislation regarding applications for action is found in the Commission Regulation (EC) No 1891/2004 of 21 October 2004 implementing Council Regulation (EC) No 1383/2003 and Commission Regulation (EC) No 1172/2007 of 5 October 2007 amending Regulation 1891/2004.
