Case: Postal parcels with bags and purses detained by SKAT

58 bags and purses, etc. – imported in postal parcels from the Philippines – were detained by SKAT because of the suspicion that they were counterfeited or pirated.

SKAT then took contact to the rights holder of the genuine bags and purses, which confirmed that they were counterfeited.

The Danish citizen who had imported the goods would not make a settlement with the rights holder and then the case was brought to the Maritime and Commercial Court.

On the 4 May 2006 the importer was sentenced to pay 94.950 kroner in compensation to the rights holder to have infringed his rights by introducing the counterfeited handbags and purses, and it was concluded that there had been an infringement of trademark law and design law.

The pirated handbags and purses were then destroyed by SKAT.
