Case: Purchase of two wrist watches over the Internet judged as trademark infringement
The defendant had bought two fake watches from outside the EU, which were detained by Danish customs authorities. The watches cost 177 US dollars, which was well below market price. The defendant explained that the watches were presents for her daughters.
The Maritime Commercial Court ruled that:
- the detainment of the watches was just
- the watches must be surrendered to the state for destruction at the expense of the defendant
- the defendant must not import, export, sell or advertise the watches
- the costs of the case were to be paid by the defendant
The ruling that is final was given on October 29 2008. Case number V-116-07.
