Case: Supreme Court judgment of 26 January 2009: Compensation and damages to the amount of 13,500 euro for infringement of a trademark
A Nordic chain of retail stores admitted to have infringed upon a well known trademark by import and sale from the stores. The case concerned approximately 17,000 wallets, sold at 2.70 euro apiece. It was unchallenged that the infringement was negligent. The payment of damages and compensation was calculated based on the turnover of the chain with respect to the wallets of approximately 45,000 euro, and on the disturbance of the market.
